Ohio Attorney General Dave Yost, along with attorneys general from 15 other states, has urged Congress to expand access to E15 gasoline. They are advocating for the Nationwide Consumer and Fuel Retailer Choice Act of 2025, which aims to allow all states year-round access to E15 gas—a blend consisting of 15% ethanol and 85% gasoline.
Yost stated, “Ohio’s motorists, farmers and energy providers all stand to gain from this proposal. It’s good for our state’s economy, and it’s a key step toward energy independence for our country.”
Currently, a Clean Air Act exemption allows states to sell E10 gas throughout the year but restricts E15 sales to non-summer months. Ohio is among eight states permitted to sell E15 year-round. The proposed legislation would remove this restriction nationwide.
The letter highlights the challenges oil producers face due to the need to supply two types of fuel during summer months. It mentions that “year-round E15 creates certainty that allows for planning and strategic growth.”
According to the letter, American cars made after 2001 can use E15, which is also cheaper than E10. Both fuel blends have similar environmental impacts; however, E10 contains 5% less ethanol.
In addition to Yost, attorneys general from Alabama, Alaska, Florida, Georgia, Indiana, Iowa, Kansas, Louisiana, Missouri, Nebraska, North Dakota, Pennsylvania, South Carolina, South Dakota and West Virginia have also endorsed the bill.
