The Buckeye Institute has filed an amicus brief with the Wisconsin Court of Appeals in the case of Abbotsford Education Association v. Wisconsin Employment Relations Commission. The brief emphasizes the importance of maintaining a constitutional balance that respects legislative policy decisions, particularly those related to government spending.
Jay R. Carson, senior litigator at The Buckeye Institute, stated, “The careful constitutional balance envisioned by the Framers of the U.S. Constitution is based on a crucial element—judicial deference to legislative policy decisions—especially those relating to government spending.” He further noted that opponents of Wisconsin’s Act 10 should seek remedies through legislative means rather than judicial intervention.
The Buckeye Institute’s brief argues for legislative control over government spending and public employment decisions, suggesting that the circuit court overstepped its authority by invalidating legislative actions designed to save billions for the state.
This case also involves representation from the Wisconsin Institute for Law & Liberty.
