The Champaign County Agriculture Society Board has reversed its policy that banned firearms on county fairgrounds, following legal action by The Buckeye Institute. The change came after the organization challenged the policy, citing violations of both the U.S. and Ohio constitutions.
“Ohioans don’t leave their constitutional rights at the fairground gates,” said David C. Tryon, director of litigation at The Buckeye Institute. “This victory is for all those visiting the county fairgrounds who can now freely exercise their constitutional rights while enjoying a uniquely American tradition.”
The dispute began in January 2025 when The Buckeye Institute requested records about the board’s firearms ban and later filed a lawsuit to obtain those documents. After continued legal pressure, the board changed its policy in June 2025 ahead of the annual county fair.
Ohio Attorney General Dave Yost issued an advisory opinion on July 28, 2025, agreeing with The Buckeye Institute’s interpretation of state law and the Ohio Constitution regarding firearms bans on public property. At the end of proceedings, the board agreed to pay court costs incurred by The Buckeye Institute.
The decision affects attendees of events such as those listed in resources like the 2024 Champaign County Fair Book, which details activities held at the fairgrounds.
