Ohio Attorney General Dave Yost has filed a lawsuit against LLY Auto Sales, a used-car dealership in Lancaster, and its operators Luis Rafael and Luis Alejandro. The suit alleges that the business failed to provide vehicle titles to seven customers, which is required by Ohio law.
The case was filed in Fairfield County Common Pleas Court. According to the complaint, LLY Auto Sales and its operators are accused of violating both the Ohio Consumer Sales Practices Act and the state Certificate of Motor Vehicles Act.
“Ohioans shouldn’t get stuck in neutral when it comes to receiving titles to cars they rightfully own,” said Yost. “My office is focused on making sure the title process works the way it should.”
To help affected consumers, Yost’s Consumer Protection Section issued $19,236.27 from the Title Defect Recision (TDR) fund. This fund assists buyers who do not receive car titles within 40 days of purchase as mandated by state law.
Through the lawsuit, Yost seeks reimbursement for these TDR payments as well as additional funds to resolve any remaining complaints and civil penalties. The Attorney General’s office is also asking the court to bar Rafael and Alejandro from obtaining or renewing auto-dealer or auto-sales licenses.
Consumers who believe they have experienced unfair or deceptive practices can file complaints with the Consumer Protection Section at www.ohioprotects.org or by calling 1-800-282-0515.
