Three men indicted for illegal reentry offenses in Northern District of Ohio

Federal grand juries in Toledo, Ohio, have indicted three individuals for illegal reentry after being previously removed from the United States. The indictments were issued on January 7 and involve separate cases.

Francisco Constancio-Mariscal, 37, a citizen of Mexico, was found in Port Clinton, Ottawa County, on January 4. He had been removed from the U.S. at least twice before, most recently on April 28, 2011.

Guillermo Gutierrez-Rivas, 35, also a Mexican citizen, was located in Benton Township (Ottawa County) on December 19, 2025. His most recent removal occurred on June 29, 2024.

Alvaro Veliz-Gonzalez, a 34-year-old citizen of Guatemala, was found in Toledo (Lucas County) on December 8, 2025. He had been removed from the country at least four times before; the latest was October 11, 2021.

All three individuals are charged with violating Title 8 U.S. Code §1326 by being present in the Northern District of Ohio without consent from either the U.S. Attorney General or the Secretary for Homeland Security for readmission.

The investigations were conducted by U.S. Border Patrol’s Sandusky Bay Station and Immigration and Customs Enforcement. Prosecution is being handled by Assistant United States Attorneys Sara Al-Sorghali, Robert N. Melching, and Alissa M. Sterling for the Northern District of Ohio.

An official statement clarified: “An indictment is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.”

These prosecutions fall under Operation Take Back America—a nationwide initiative led by the Department of Justice to address illegal immigration and combat cartels and transnational criminal organizations while aiming to protect communities from violent crime perpetrators.
