Okeechobee police chief faces backlash over temporary gun ban

Donald C. Hagan, the chief of the Okeechobee Police Department in Florida, is facing national scrutiny after signing an ordinance that banned firearm and ammunition sales, as well as possession, shortly before Hurricane Helene was expected to hit. Hagan's spokesman reported on September 30 that the chief has taken some time off due to receiving personal attacks from across the country.

A police receptionist confirmed on October 1 that Chief Hagan was unavailable, directing inquiries to Major Bettye Taylor. Taylor issued a statement attempting to explain the situation but left questions unanswered. "The Emergency Ordinance commenced immediately upon the declaration by the Police Chief and was thereafter terminated by the Police Chief on or about 9:51 pm on the same date it was issued," she wrote. She added that a provision prohibiting firearms and ammunition sales was "inadvertently included" and emphasized swift action to terminate the ordinance.

Taylor assured residents and gun owners nationwide that no harm was caused by the temporary ban. "At no time did the City, or the Police Chief, contemplate, nor take any action, to prohibit, confiscate or otherwise regulate firearms or ammunition," she stated.

However, this claim contrasts with what was outlined in the ordinance signed by Hagan. The document prohibited sales and public possession of firearms by anyone other than law enforcement or military personnel performing official duties.

Florida's preemption statute reserves regulation of arms for state legislators alone. Public officials violating this statute risk removal from office and fines up to $5,000 paid personally.

Detective Jarret Romanello mentioned that city officials are reviewing how this incident occurred and promised more answers post-review. He noted most criticism came from outside city limits.

Despite assurances from Okeechobee authorities about inadvertence in their actions, concerns remain among gun owners regarding Second Amendment rights. The situation has drawn attention beyond local borders due to its implications for civil liberties during emergency situations.
