The Buckeye Institute has filed an amicus brief in the case of Wilson v. Hawaii, urging the U.S. Supreme Court to review a decision by the Hawaii Supreme Court concerning Second Amendment rights. The filing calls for the U.S. Supreme Court to assert its authority over state courts regarding constitutional interpretations.
“Under the guise of interpreting its state constitution, the Hawaii Supreme Court demonstrated its open disdain for the U.S. Supreme Court’s Second Amendment decisions,” said David C. Tryon, director of litigation at The Buckeye Institute. “But the U.S. Supreme Court’s decisions are the law of the land with regards to the U.S. Constitution, and Hawaii cannot simply ignore the court or parts of the Constitution that they believe are ‘inconsistent with the Spirit of Aloha.’”
The brief requests that the U.S. Supreme Court grant a petition to reverse Hawaii's ruling and reinforce that lower courts must adhere to established precedents set by higher courts.
