Criticisms arise over effectiveness of red flag laws and universal background checks

On July 2, 2024, Joe D. "Buck" Ruth discussed the complexities surrounding red flag laws and universal background checks in an article. He critiqued the policies promoted by anti-gun advocates, particularly those governing violence-prone cities.

Ruth began by addressing Columbus Mayor Andrew Ginther's stance on Ohio's gun laws. Ginther had stated, "Who opposes a red flag law? This state legislature has put in place some of the most reckless and dangerous gun policies in America." Ruth countered this by arguing that relaxed concealed-carry laws are not to blame for crime rates, suggesting instead that illegal handgun possession is a more significant issue.

The article then delved into red flag laws using Everytown for Gun Safety’s definition: "When a person is in crisis and considering harming themselves or others, family members and law enforcement are often the first people to see the warning signs. Extreme Risk laws, sometimes referred to as 'Red Flag' laws, allow loved ones or law enforcement to intervene by petitioning a court for an order to temporarily prevent someone in crisis from accessing guns."

Ruth highlighted potential abuses of such laws with an example involving a Pennsylvania state trooper who allegedly misrepresented texts from his ex-girlfriend to have her committed involuntarily. He also cited a study led by John Lott Jr., published by Michigan State University in 2018, which found no long-term effect on murder and suicide rates following the implementation of red flag laws.

Regarding universal background checks (UBC), Ruth noted widespread initial support but pointed out how specific scenarios could change public opinion. In one survey conducted by Lott's organization, respondents were asked if they would support UBCs even if it meant becoming felons for lending firearms under certain circumstances. Opposition outweighed support when participants considered these individual situations.

Ruth concluded with a cautionary note against taking these measures at face value: "Don't be fooled. Red flag laws and universal background checks might seem divinely inspired, but understand that the devil is in the details."
