Buckeye Institute files second brief against Biden’s student loan forgiveness plan

On July 15, 2024, The Buckeye Institute submitted its second amicus brief in the case of Alaska v. U.S. Department of Education, urging the U.S. Supreme Court to review the matter. The brief argues that President Biden's SAVE program, which aims to transfer student loan debt to taxpayers, exceeds the legal authority of the Secretary of Education and was adopted improperly.

David C. Tryon, director of litigation at The Buckeye Institute, stated, "One year after the U.S. Supreme Court told President Biden that his administration does not have the authority to forgive billions in student loan debt and leave taxpayers holding the bag, here we are again." He added that this new plan also violates the U.S. Constitution and attempts to bypass Congressional authority.

The Kansas Justice Institute and the National Taxpayers Union Foundation have joined The Buckeye Institute's brief.

In May 2024, The Buckeye Institute filed an amicus brief in Kansas v. Biden with the U.S. District Court for the District of Kansas and had previously filed briefs in both Biden v. Nebraska and U.S. Department of Education v. Brown cases. In December 2022, it also challenged President Biden’s original loan forgiveness plan through Latta v. U.S. Department of Education.
